At Foto Source Canada Inc., ("foto source") we take your privacy very seriously. This Privacy Policy describes how we use information about our customers, such as name, address, email address, credit card number, etc. ("Customer Information"). Primarily, we collect such information in order to provide you with great products and services. Except as specifically described in this Privacy Policy, we do not sell, rent or share your Customer Information with third parties. This policy does NOT govern how individual foto source retailers use personal information that they collect. Please contact your local store for their policy. Note also that our web site may contain links to third party web sites. If you click away from our website to visit the site of any third party, you may be asked for personal information in order to use that site. foto source has no responsibility and assumes no liability for these sites. You should therefore review their terms of use and privacy policies carefully if you have concerns about how your information may be used.

 

By providing your Customer Information to us, you consent to its collection and use in the manner described below. Changes to this policy will be posted to our website (www.fotosmart.ca), at times without notice. Please check the website from time to time to make sure you are aware of our latest privacy practices.

What Customer Information We Collect

Customer Information is requested whenever you choose to use our services. The type of information we request has to do with the type of service you are using. For example, when you want to upload digital pictures or view others' pictures on our website, we will ask you to provide your first and last name, an email address and a password. When you want to share your pictures with your contacts, we will ask for the names and email addresses of your contacts. When you want to order prints or photo gifts, we will also ask for your address and credit card information so that we can fulfill your request.

 

You also give information when you answer survey questions, enter contests, sign up for newsletters and organize your photos with titles, album names, etc. Some information is optional, and required information is usually indicated with an asterisk (*) beside the field name. You always have a choice about what information you provide, but if you choose not to provide information that we require for a service, we cannot provide that service to you.

How We Use Customer Information

Our primary goal in collecting your Customer Information is to provide you with personalized, convenient and user-friendly service. In conjunction with any of the services we provide for you, we may use your Customer Information to contact and correspond with you and to respond to your inquiries. For example, we may use your email or mailing address to tell you when your photos are ready to view online, tell you that others want to share their photos with you, tell you that others want to see your photos, inform you of the status of an order you placed, or send you your password if you've forgotten it. With your consent, we may also use your email address to send you newsletters or promotional mailings regarding goods or services we believe will interest you. You can choose not to receive promotional mailings by changing the settings in your profile (click Login and then My Profile in the top right-hand corner of the website).

 

We also use Customer Information to provide you with the convenience of easy access to the services you request. For example, when you choose to order from our online store, we will ask for credit card and address information in order to process and ship your order.

 

We reserve the right to use aggregated, anonymous data about our users as a group. For example, we might tell a prospective advertiser that 5,000 of our customers are digital camera users, to develop an attractive offer exclusively to those users. Your Customer Information, however, will never be personally identifiable when aggregated for these purposes.

Who We Share Customer Information With

We share Customer Information with third parties who help us provide our services to you (e.g. credit card authorization companies, merchandise distributors, etc.). Your Customer Information is provided to these third parties solely for the purpose of providing you the services you request at the time that you request them. Third parties do not store, retain, access or otherwise use your Customer Information other than as necessary to provide you with the requested service. Additionally, if we are required by Canadian law (or to protect our rights or property), we will disclose Customer Information to the extent so required. Other than this, we will not sell, rent or otherwise share Customer Information with a third party without your knowledge and consent.

Who Sees Your Photos

You and your contacts can see your photos online. Your contacts are any people that you have invited to the website to see your photos. Anyone who is invited to view photos online must provide an email address and a password to access the site and can only view the photos that you have shared.

 

Our employees, or employees of our retailers or partner companies that provide services to us, may see your photos while they are being developed, printed or uploaded. In addition, your photos or personal account information may be seen by our employees or service providers in order to evaluate, validate, or correct problems with your account.

How We Use Your IP Address

An IP address is your computer's address and is a unique identifier, allowing online information to be sent to the right place. We use your IP address to help diagnose problems with our server and to administer our website. Your IP address may also be used to gather broad demographic information such as geographic distribution of our customers. In addition, our servers (like all web servers) log information about your computer such as the operating system and browser you use. We do not intentionally link your IP address to your personally identifiable Customer Information.

How We Use Cookies

Cookies do not extract private or personal information from your computer. Cookies are small files placed onto the hard drive of your computer when you visit our website that enable our server to "remember" some information as you go from page to page and also next time you visit the site. Cookies are not tied to personally identifiable Customer Information. They are used to retain preferences such as your local foto source retail store, and to hold session information such as a "shopping cart".

 

You always have a choice with respect to cookies. By modifying your browser preferences, you can accept all cookies, be notified when a cookie is set, or reject all cookies. If you choose to reject all cookies, you may be unable to use certain features of the website. Please consult your browser documentation for information on how to change your cookie settings.

How We Protect Customer Information

Your Customer Information is password-protected and regularly backed-up. Our terms of service require that you do not share your website username or password with anyone. We recommend that you use a secure password (at least eight characters, mixing letters and numbers and not easy to guess) and that you change it at least once a year. You may edit your account information by using your foto source username and password to log in and then clicking My Profile in the top right-hand corner of the website.

 

If you are using a public computer (public library, school computer, etc.) or a shared computer (family computer, roommate's computer, etc.), we strongly recommend that you logout of your foto source account and close your browser before leaving the computer. This will prevent others from accessing your account and personal information. Please note that because we are concerned about protecting information about children on the Internet, children under the age of majority are not eligible to use foto source services. However, we encourage parents to use our service as a family activity with their children and to carefully monitor any Internet activities engaged in by their children. We employ SSL encryption technology to protect your Customer Information while in transit between computers. We understand that this is especially important when there is an exchange of credit card, billing and password information. In addition, we limit access of Customer Information to only those employees who need it to carry out their jobs.

 

We will never ask you for your password in an unsolicited phone call or in an unsolicited email. You will only be asked for your username and password when you initiate the contact and only if the username and password are necessary to correct a service problem.

How You Can Update Your Customer Information

Customer Information that you provide during registration is available in your foto source online profile. You may edit your account information at any time by logging in and clicking My Profile in the top right-hand corner of the website.

 

You can inactivate your account by contacting us in writing. If you request cancellation of your account, we may (but are not required to) remove any and all content (photos) or other personal information from the website, and your photos may not be accessible to you even if you choose to rejoin or reactivate your account at a later date. Information necessary for the purposes of maintaining business records regarding a cancelled account, including records of transactions and account ownership, will be retained by us even if your account is inactivated. In addition, we may be required by law to keep copies of potentially illegal material.
